Getting and keeping a Colorado license: levels, E&O insurance, renewal, continuing education, inactive status

Colorado Real Estate Contracts and Regulations · 3 study hours

Bottom line: To get a Colorado license you finish the course hours, pass both exam parts, clear fingerprints, and carry E&O insurance; to keep it you renew every third December 31 with 24 hours of continuing education, tell the Commission at once when you change employer or address, and reinstate quickly if it expires.

Bottom line: getting licensed has four gates: education, the exam, a fingerprint background check, and E&O insurance. Keeping it means renewing on time, finishing continuing education, and telling the Commission right away when your job or address changes. Miss a date and the cost goes up.

Gate 1: who can apply and the education

An applicant must be at least 18 (C.R.S. 12-10-203(4)(a)). The applicant must prove either a college degree with a major in real estate, or approved coursework from an accredited college or an approved real estate school. The law counts 48 + 48 + 72 hours, a total of 168 hours (C.R.S. 12-10-203(4)(a); Rule 2.1.A):

  • Real Estate Law and Real Estate Practice: 48 hours
  • Colorado Real Estate Contracts: 48 hours
  • Real Estate Closings: at least 24 hours
  • Trust Accounts and Record Keeping: at least 8 hours
  • Current Legal Issues: at least 8 hours
  • Practical Application: at least 32 hours (24 + 8 + 8 + 32 = the 72 hours)

A person already licensed as a broker in another state needs only the contracts course and the closings course. A person who was a salesperson elsewhere needs the contracts course and the full 72 hours (C.R.S. 12-10-203(4)(b), (c)). The Commission may also issue a license to a person licensed 2 or more years elsewhere whose credentials are substantively equivalent (C.R.S. 12-10-203(5)(b)).

Gate 2: the exam

The exam has two parts: a national part and a Colorado part (Rule 2.2.A). You finish the education first and file proof before you sit (Rule 2.2.C). If you fail one or both parts you may retake the failed part. A passing score on either part is valid for one year; if you do not file a complete application within that year the score is invalid (Rule 2.2.F; C.R.S. 12-10-212(2)). The state exam also includes preparing a closing statement (C.R.S. 12-10-203(5)(a)).

Gate 3: background check

Before applying you submit fingerprints to the Colorado Bureau of Investigation (CBI) for a state and national criminal history check, and you pay the CBI fee (C.R.S. 12-10-203(1)(b)(I); Rule 2.3). If you held a license in another jurisdiction, you file a certified license history from each, dated within 90 days of your application (Rule 2.4). A past conviction does not automatically bar you; you must file court records and the Commission weighs them (Rule 3.4).

Gate 4: errors and omissions (E&O) insurance

E&O insurance pays when a customer says your mistake cost them money. Every licensee must carry it, except an inactive broker or an attorney whose malpractice policy covers the work (C.R.S. 12-10-204(1)). You need it before you get an active license (Rule 3.1.A). The Division offers a group policy; you may buy your own if it meets the minimums (C.R.S. 12-10-204(1)). Minimums in Rule 3.9:

  • At least $100,000 per covered claim per licensed person or firm, and at least $300,000 yearly aggregate (total), not counting defense and investigation costs.
  • Deductible of no more than $1,000 per occurrence.
  • Lock box coverage of at least $25,000 per occurrence.
  • A firm that carries its own firm policy must have at least $1,000,000 per claim and $1,000,000 aggregate, with a deductible of no more than $10,000.

The Commission tells licensees the terms at least 30 days before the annual premium renewal date, and each licensee files a certificate of coverage by that date (C.R.S. 12-10-204(3)). Certifying coverage you do not have is a problem (Rule 3.9.D).

Three license levels

  • Associate broker: works under the supervision of an employing broker (Rule 1.6). No experience required to apply (Rule 2.5.A). The employing broker has custody and control of the associate's license (C.R.S. 12-10-211(2)).
  • Independent broker: may work on one's own. Needs at least 2 years of active licensure as an associate (C.R.S. 12-10-203(5)(c)(I); Rule 2.5.B, 2.7). The law says a broker who did not hold a license on December 31, 1996 cannot practice independently before two years of active service.
  • Employing broker: may hire and supervise other brokers. Needs 24 hours of brokerage administration (Rule 2.1.B) and must show enough experience and knowledge (C.R.S. 12-10-203(5)(c)(II), (III); Rule 2.8).

Every broker residing in Colorado who is independent or employing must keep a place of business in the state; associates and inactive brokers are excepted (C.R.S. 12-10-203(2); Rule 3.10). A firm (company) license is possible, but a qualified, active broker must be named to supervise, and that broker must pass the exam for the firm (C.R.S. 12-10-203(6)). Firms do not renew; the broker does (Rule 3.11.A).

Renewal cycle and dates

Licenses renew on a three-year calendar cycle: January 1 of year one through December 31 of year three (Rule 3.11.B.1; C.R.S. 12-10-212(4)(a)(I)). An initial license issued on or after April 23, 2018 expires December 31 of the year it was issued, so it is short and has no continuing education to finish (C.R.S. 12-10-212(4)(a)(I), 12-10-213(4)). You may renew starting 45 days before expiration. Active and inactive licenses both renew (Rule 3.11.B.3, 3.12.C). The Commission emails the expiration notice to the email on file, so keep it current.

Continuing education (CE)

A standard three-year cycle needs 24 hours (C.R.S. 12-10-213(1)(a)). Twelve are Commission-created credits, taken as the Annual Commission Update in 4-hour yearly pieces, plus 12 hours of electives (Rule 4.2.A.1). You pass the Update by scoring 70 percent (Rule 4.3.C). A license shorter than three years needs at least 8 Commission credit hours (C.R.S. 12-10-213(1)(b)). Alternatives: pass the Colorado part of the exam again, take the 24-hour Broker Reactivation Course (only under conditions, such as being inactive or expired up to 36 months), or retake the contracts and closings courses (72 hours) (Rule 4.2.A.3-5). CE rules: max 8 hours a day, no repeating a course in the same calendar year, no carrying extra hours forward, and keep certificates 4 years (Rule 4.5).

Changes, inactive, expired

You must give immediate notice of any change of business location or employer. If you do not, your license is automatically inactivated (C.R.S. 12-10-211(1)). When you leave a broker, both you and the broker must immediately notify the Commission, and you may not do licensed acts after the employment ends (C.R.S. 12-10-211(3), (4)). The law gives no number of days; "immediate" is the standard. (The 30-day deadline in Rule 6.23 is for reporting convictions and similar events.)

Inactive means you hold the license but cannot do licensed work. An inactive broker may still be paid commissions earned while active (Rule 3.12.D). Expired means you missed renewal. Reinstating (Rule 3.15):

  • Within 31 days after expiration: pay the renewal fee.
  • More than 31 days but within 1 year: renewal fee plus a reinstatement fee equal to half the renewal fee.
  • More than 1 year but within 3 years: renewal fee plus a reinstatement fee equal to the full renewal fee.

In the last two cases the new license runs 3 years from the old expiration date.

Example with real numbers

Say a license expired December 31, 2025 and the renewal fee is $200 (an example figure; the Division sets the real fee). You file February 15, 2026, which is 46 days late and within 1 year. You pay $200 + $100 (half) = $300. The new license expires December 31, 2028. CE: 12 Commission hours (three 4-hour Annual Commission Update courses) plus 12 elective hours = 24 hours. If you had filed January 20 (20 days late) you would pay only $200. Separately, suppose a $60,000 claim against the broker with a $1,000 deductible: the insurer pays $59,000 of covered loss, within the $100,000 per-claim minimum, and defense costs are on top of the limit.
